Your privacy is very important to 4PSA. 4PSA protects your personal information and created this privacy statement (the "Privacy Policy") in order to demonstrate our firm commitment to privacy.
This Privacy Policy describes how 4PSA, as controller within the meaning of the EU General Data Protection Regulation no. 2016/679 ("
GDPR") collects and processes the personal data and other information of data subjects when offering the 4PSA services (the "
Services"), 4PSA software (the "
Software") and the 4PSA websites
www.4psa.com and
www.hubgets.com (collectively the "
4PSA Website").
The purpose of this Privacy Policy is to establish the principles underlying the processing of personal data that You transmit to us or which we obtain about You. This Privacy Policy also explains Your rights and choices about how we use information about You, how You can object to certain use of information about You and how You can access and request us to update certain information about You.
Our Services and Software are generally designed for legal entities, not offered directly to end-users. In case our Services or Software are provided based on a contract with a legal entity, this legal entity ("Your Company") controls the information about You that may be processed by 4PSA. For more information, please see End-Users Note below.
Please read this Privacy Policy carefully. You must agree with this Privacy Policy in order to acquire and use the 4PSA Services, 4PSA Software, to use the 4PSA Website and to subscribe/access to 4PSA Community. You must agree with this Privacy Policy when obtaining a License Key or License Activation Code generated, managed or updated by using 4PSA Business Zone or by getting an evaluation license.
Rack-Soft, Inc., a US based company with its principal place of business at 4250 Lancaster Pike, Suite 120, Wilmington, DE 19805 is the data controller responsible for the processing of personal data as described in this Privacy Policy – referred to in this Privacy Policy as "4PSA".
Rack-Soft SRL, a Romanian company with its principal place of business at 20-22 Bilciuresti Str., 2nd floor, Sector 1, Bucharest, 014012 Romania, has been appointed as our representative within the meaning of Art. 27 of the GDPR.
Collection of Your Personal Information
4PSA collects and processes Your personal information ("
Personal Information") as described in this Privacy Policy. Personal Information collected by 4PSA often is limited to:
but may include other information when needed to provide a Service or Software You requested.
4PSA requests Personal Information when (i) You place an order, (ii) request a Service, (iii) ask for an evaluation license or an evaluation of the 4PSA Cloud OnDemand service (iv) access the 4PSA Website, (v) answer a survey, (vi) enter a contest, (vii) correspond with us or engage in certain other activities on 4PSA Website; (viii) subscribe to /access the 4PSA Community. For example:
If You
submit an online order or an evaluation request with 4PSA, You will be asked for Personal Information needed to complete the transaction or the request, such as Your name, Your company name, Your company address, telephone number, and e-mail address. The credit/debit card number and/or PayPal account related information submitted online is processed directly by the bank/payment gateway used by 4PSA for card payments or PayPal. 4PSA does not collect and will never know Your credit/debit card number and/or PayPal account related information. In such a case, the processing of Personal Information is necessary for the performance of a contract to which You or the company You represent are a party or in order to take the necessary steps upon Your request prior to entering into a contract.
In order to
perform the technical services You ordered, 4PSA will collect Your account details (such as Your name, Your company name, telephone number, e-mail address). Furthermore, 4PSA may require sensitive information such as passwords and host
addresses. This kind of information is gathered in a secure way, please do not send such sensitive data by e-mail or by using the public communities. The methodology to send this information is described when 4PSA requests such information. You make all the decisions so as to proceed with any activity that requests Personal Information or not. However, please note that if You do not wish to provide the requested information, You may not be able to complete the transaction or 4PSA may not be able to provide the Services or the Software You requested or to complete Your order.
You may
use the 4PSA Website without providing any Personal Information about You (except for the IP address). In this case, 4PSA will collect only the following metadata that result from your usage: referral page, date and time of access, data volume transmitted, status of transmission, type of web browser, operating system and interface, language and version of browser software. Your IP address will be used to enable Your access to our 4PSA Website. The metadata, including the IP address will be used to improve the quality and services of our 4PSA Website by analyzing the usage behavior of our users. The legal basis for processing in this case is Your consent, which will be specifically requested to You when accessing the 4PSA Website. In case You want to correspond with us via the 4PSA Website, we will collect your name and e-mail address, as well as any Personal Information that You make available to us through the content of Your message. 4PSA will use the Personal Information You provide in this context for the possibility to contact and correspond with You. The legal basis for processing is in this case Your consent, which will be specifically requested to You when creating Your account.
If You
participate in a contest, 4PSA collects and processes the following Personal Information about You: name, postal address, email address, date of entry, answer to specific questionnaire/Your performance. If you are selected as a winner, 4PSA will also collect and process the following personal data and information about You: selection as winner, prize offered, phone number, postal address, series and number of your ID card. 4PSA processes such personal data for purposes of carrying out the contest, informing the winner, delivering the prize to the winner, carrying out the event, and marketing purposes (in such latter case, based on your consent). The legal basis for processing is the necessity for 4PSA to perform the contract to which You become a party once You enter the contest and accept the contest rules, or the need for 4PSA to take the steps at Your request, prior to entering into a contract regarding your participation at the contest, except for processing for direct marketing purposes, for which the legal basis of the processing will be Your consent.
If You want to interact on
the 4PSA Community (the "4PSA Community"), You will be required to provide Your name (which may be different than Your official name) and Your email address, in order to create Your account. You may also choose to provide a profile picture and Your location, to be associated with Your account. The legal basis for processing in this case is Your consent, which will be specifically requested to You when creating Your account in the 4PSA Community and when You decide to provide Your picture and Your location.
Legal Basis for Processing (for EU Data Subjects)
If you are an individual in the European Union, we collect and process Personal Information about You only where we have legal basis for such processing in accordance with the GDPR. The legal basis that 4PSA relies on when processing Your Personal Information depends on the type of the processing, as described in the section above, namely:
You have given Your consent to the processing of Your Personal Information for one or more specific purposes (such as when You subscribe to our newsletter, or You agree to subscribe/access the 4PSA Community);
The processing is necessary for the performance of a contract to which You are a party or to take steps at Your request prior to entering a contract;
The processing is necessary for compliance with a legal obligation to which we are subject to;
The processing is necessary to protect Your vital interests for You or for another natural person;
The processing is necessary for the purposes of the legitimate interests pursued by us or by a third party, except where such interests are overridden by Your interests or fundamental rights and freedoms, which require protection of Your personal data;
Other applicable legal bases for data processing, especially provisions set out by member state law.
If the legal basis for the processing is Your consent, You have the right to withdraw at any time Your consent to the processing, without this affecting the lawfulness of previous processing under Your consent, until the date of Your withdrawal. This might lead however to Your inability to interact with the 4PSA Community for example.
Use of Personal Information - the Purposes of the Processing
4PSA collects data from You for the following purposes:
To complete a transaction. Name, address, email, IP address, and purchase details may be collected and stored as part of the transaction history. The majority of the data collected under this category is contact information. 4PSA does not collect and will never know Your credit/debit card number and/or PayPal account related information. When You make a payment for a transaction, You will be required by the provider of the payment services to make available certain Personal Information, but 4PSA does not collect and does not process such payment information. However, 4PSA may need to share some of Your Personal Information that 4PSA collects in according to this paragraph (name, address, email and purchase details) with credit/debit card clearing houses, banking institutions, payment gateway companies, and other similarly situated Agents, who may require the information in order to complete the transaction (as used here, "Agents" are persons or companies who act on behalf of or under the direction of 4PSA, acting as its data processors).
To provide future service and technical support. Information collected for this purpose is both contact data and information related to the requested Software and Service. This
information is also used to provide service, Software updates, and similar notices.
To respond to law enforcement organizations, government officials, or third-parties when compelled by subpoena, court order, or applicable law, or to report or prevent suspected fraudulent or illegal activity in the use of 4PSA's services. 4PSA will notify You of the information request or submission, as and if allowed.
To provide various 4PSA communities with relevant Software alerts and updates. These updates are related to Software releases, prices, terms, special offers, and associated campaigns. This data is sent when the program member signs up for the relevant program or online account, being therefore subject to Your consent.
To better tailor marketing campaigns to user needs. 4PSA may use information from user purchases and user-specified requirements to provide You with timely and pertinent notices of Software releases and service developments that address Your needs and specified requirements, subject to Your consent.
To keep you up-to-date with
4PSA Services and Software. These updates are related to Software releases, terms and new applicable prices related to Your 4PSA Services and Software.
To select content. Data may be collected to help create website content and navigation that is most relevant and user friendly. This includes data collected as a result of site navigation, as well as data provided in forms.
To respond to Your inquiries and requests for information.
To provide You with online newsletters in case You have subscribed to our newsletter or opt-in mailing lists.
To allow You to use the interactive discussions groups and public 4PSA Community. There are parts of the 4PSA Website that permit You to participate in interactive discussions, like the 4PSA Community. Some of these are moderated; all are subject to access for technical reasons. 4PSA does not control the content that users post and some may serve as public discussion forums. As in any interactive forum open to many users, You should carefully consider whether You wish to submit data and Personal Information and should tailor any other submitted content accordingly.
From the information submitted on Your 4PSA Community account, details that You filled in the "Full Name" field (which is mandatory), profile picture, "Location" and "About you" fields (which are not mandatory)are public. The information You fill in the "Full name" field may or may not be Your real, full name. We also require a valid email address; however, this is not public information, but will be processed by 4PSA to create and manage Your account in the 4PSA Community.
The content You submit in 4PSA Community is visible to any visitor and is associated with the public information of Your 4PSA Community account, which is visible to all visitors of the 4PSA Community. The date when You submit content in the 4PSA Community is also visible. The content created by You in the 4PSA Community includes Your questions and comments, which may include text, links, images, and any attached files and this is processed by 4PSA to run the 4PSA Community and may also be processed by all the other users of the 4PSA Community. Your interactions with the content published in the 4PSA Community, like voting or following users and questions is visible only to You and is processed by 4PSA Community as part of its process of managing the 4PSA Community.
To ensure safety and security. We may use Your Personal Information and information regarding the use of our Services and Software to verify accounts and associated activity, to monitor suspicious or fraudulent activity and to identify violations of 4PSA's MSA and related policies.
For statistics purposes. When You visit the 4PSA Website, 4PSA may track statistical information on You that includes but is not limited to domain names, IP addresses, browser types, screen resolution. 4PSA uses this information to produce traffic statistics for the 4PSA Website. Except for the IP address, such information is not correlated with any of Your Personal Information. Information that is aggregated or de-identified so that it is no longer linked to You does not fall under this Privacy Policy, as it does not refer to Personal Information and therefore 4PSA has no limitation to use it, in accordance with applicable law.
Sharing Your Personal Information with Recipients other than the Company
4PSA is taking Your privacy extremely seriously and we shall never sell Your data, nor Your Personal Information.
4PSA will not share Your Personal Information with third-parties without Your permission, other than for the limited exceptions listed in this Privacy Policy. Personal Information will only be used for the purposes stated above.
4PSA may engage external service providers, who act as data processors of 4PSA, to provide certain services to 4PSA, such as: infrastructure providers, payment processors, marketing partners, and other software-as-a-service providers, all acting under contractual provisions regulating the data controller – data processor relationships and strict confidentiality obligations. When providing such services, the external service providers may have access to and/or may process Your Personal Information.
We request external service providers to implement and apply security safeguards, as well as appropriate technical and organizational measures to ensure the privacy and security of Your Personal Information. In addition, any service provider that would process Your Personal Information as a data processor, would act based on a contract executed with 4PSA, which complies with the relevant provisions of the GDPR.
4PSA may transfer - in compliance with applicable data protection law - Personal Information to law enforcement agencies, governmental authorities, legal counsel and external consultants, for the purposes of complying with a legal obligation, regulations or a legal request; for the benefit of the legal or other external services; and / or to defend its rights and interests; when necessary to protect the life, safety, rights, or property of the public, of any person, or of 4PSA; or to prevent, detect or otherwise address fraud, security or technical issues.
In case of a corporate merger or acquisition or in case of an asset deal, Your Personal Information may be transferred to the third parties involved in the merger or acquisition, as part of the transaction. You will be notified via email and/or other means of notification via the Services if a transaction takes place, as well as about the choices You will have regarding Your Personal Information.
4PSA shares collected Personal Information with affiliated companies, namely companies owned or operated by 4PSA, or under common control with 4PSA for ensuring intra-group reporting and provision of services between group companies. The protections of this Privacy Policy apply to the information we share in these circumstances.
If You have accessed the Services using an email address with a domain that is owned by a legal entity, certain information about You including Your name and contact information is accessible to such legal entity and is under its control.
All the information submitted on the 4PSA Website is secure, except for the information publicly available in the 4PSA Community. We request You to enter Your email address, phone number or any other contact information on 4PSA Website, in order to allow 4PSA to contact You regarding further issues. You can unsubscribe from the 4PSA's database at any time. Full information on how to unsubscribe from 4PSA database is provided at the end of the emails automatically sent to You. Full information on how to unsubscribe from the 4PSA Community newsletter (if You have previously subscribed to such) is provided at the end of the emails automatically sent to You.
Period of processing Your Personal Information
Your Personal Information will be stored and processed only for the time necessary to fulfill the purposes for which the data is collected, as mentioned above.
Once our relationship has come to an end, we will either delete Your Personal Information or anonymize Your Personal Information, unless statutory retention requirements apply (such as for taxation purposes).
Personal Information collected by 4PSA to provide You with our Services and Software will be retained and processed for the entire duration of our contractual relationship. If the Services or Software are made available to You through a legal entity, we retain Your information as long as required by the administrator of your account.
If You have granted Your consent to 4PSA to send You marketing materials and communications, we may retain Your contact details and information regarding Your interests in our products or services for a long period of time, which shall not exceed 5 years.
Also, we may be required by applicable law to retain certain of Your Personal Information for a period of 10 years after the relevant taxation year. We may also retain Your Personal Information after the termination of the contractual relationship if Your Personal Information is necessary to comply with other applicable laws or if we need Your Personal Information to establish, exercise or defend a legal claim, to the necessary extent only. To the extent possible, we will restrict the processing of Your Personal Information for such limited purposes after the termination of the contractual relationship.
The Personal Information provided by You as part of Your account in the 4PSA Community (except for the content associated with Your account) is kept and processed by 4PSA as long as You have a valid account on the 4PSA Community or until You decide to erase from Your account the information that was not mandatory for setting up Your 4PSA Community account. If You decide to close Your account in the 4PSA Community, the content associated with Your account cannot be deleted and will remain available in the 4PSA Community as if posted by an anonymous user (not related with Your "Full Name"), unless You first hid this content before account deletion.
Your rights in relation to Your Personal Information and how You can exercise Your rights
If you are an individual in the European Union, You have the following rights, pursuant to the GDPR:
(i) to request access to Your Personal Information, to obtain confirmation as to whether or not Your Personal Information is being processed by 4PSA and to obtain a copy of Your Personal Information that is being processed. 4PSA provides You with means to ensure that Your Personal Information is correct and up-to-date. You can access Your Personal Information by contacting 4PSA. If you have an account with 4PSA, You can update Your Personal Information in Your 4PSA Business Zone account at
4PSA Business Zone account. You can also update Your Personal Information in Your
4PSA Support Zone account. Likewise, if You are member of 4PSA Community, You can update Your Personal Information from Your 4PSA Community account (except for the Personal Information included in Your published content);
(ii) to request rectification of Your Personal Information;
(iii) to request erasure of Your Personal Information: (a) Your Personal Information are no longer necessary in relation to the purposes for which it was collected or otherwise processed; (b) if You withdraw Your consent, for processing, if this was the legal base for processing and where there is no other legal ground for the processing; (c) if You object to the processing and there are no overriding legitimate grounds for the processing, or if You object to a processing for marketing purposes or profiling; (d) if Your Personal Information has been unlawfully processed; and/or (e) if Your Personal Information has to be erased for compliance with a legal obligation in Union or Member State law to which 4PSA is subject. If You have an account with 4PSA, You can correct, update or delete Your Personal Information in Your 4PSA Business Zone account or in Your 4PSA Support Zone account (except for the ones necessary for Services and Software delivery by 4PSA, which may not be deleted). If You want to exercise Your right to have Your Personal Information erased from the 4PSA Community, please submit a request at privacy@4psa.com. When Your 4PSA Community account is deleted, Your profile is no longer visible to other users and disassociated from content You posted under that account. Please note, however, that the posts, answers, and comments You submitted prior to Your account deletion will still be visible to others as posted by an anonymous user, unless You first hid this content before account deletion;
(iv) to request restriction of processing Your Personal Information, if You contest the accuracy of Your Personal Information, for the period enabling us to verify the accuracy of Your Personal Information, if the processing is unlawful and You oppose to the erasure of Your Personal Information and requests the restriction of its use instead, if 4PSA no longer needs Your Personal Information, but such is required by You for the establishment, exercise or defense of legal claims, or if you objected to processing pending the verification whether the legitimate grounds of 4PSA override Your legitimate rights;
(v) to request data portability to another data controller, if You have provided Your Personal Information in a structured, commonly used and machine-readable format and this has been processed by 4PSA based on Your consent or based on a contract executed with You;
(vi) to object to the processing of your Personal Information (including objection to profiling) if 4PSA processes Your Personal Information based on legitimate interest;
(vii) to object to being subject to a decision based solely on automated processing (including profiling) which produces legal effects concerning You or similarly significantly affects You and
(viii) the right to lodge a complaint with a supervisory authority.
If You have declared Your consent regarding certain collecting, processing and use of Your Personal Information, You can revoke this consent at any time with future effect. Furthermore, You can object to the use of Your personal data for marketing purposes without incurring any costs other than the transmission costs in accordance with the basic tariffs and without this affecting the use of the Services and Software You have contracted. For example, if You have given Your consent to 4PSA in this respect, You may opt out of receiving marketing communications from us by using the unsubscribe link within each email, or by contacting us and requesting to have You removed from our marketing email list or registration database.
Your request to exercise Your rights above may be limited in certain situations generated by the fact that, for example, Your request would reveal information about another person, or in case You ask us to delete information which we or your employer have a legitimate interest for keeping and further processing.

Access to Your Personal Information
Also, if you are an individual outside the European Union, 4PSA provides You with means to ensure that Your Personal Information is correct and up-to-date. You can access Your Personal Information by contacting 4PSA. You can also update Your Personal Information in Your 4PSA Community account. If you have an account with 4PSA, You can update Your Personal Information in Your 4PSA Business Zone account. You can also update Your Personal Information in Your 4PSA Support Zone account. You are entitled to request the correction, update, restriction and deletion of Your Personal Information under the conditions mentioned in this Privacy Policy. You have the right to object at any time, based on legitimate grounds, regarding the processing of Your Personal Information by 4PSA.
Security of Your Personal Information
4PSA has taken security measures, consistent with the law of the State of Delaware and international information practices, to protect Your Personal Information. We have also implemented the technical and organizational measures required by GDPR to ensure the security of Your Personal Information. These measures include technical and procedural steps to protect Your data from misuse, unauthorized access or disclosure, loss, alteration, or destruction. All Your Personal Information that are processed by 4PSA, including critical information is transmitted using secure socket layer (SSL) encryption.
4PSA stores the Personal Information You provide in computer servers with limited access that are located in controlled facilities.
International Users
If You are visiting from the European Union or other regions with laws governing data collection and use, please note that You are agreeing to the collection and processing of Your Personal Information by 4PSA, which is a legal entity organized under the laws of the United States. If You are not an US citizen, please be informed that we process and store Your Personal Information outside of Your country of residence, in US or in other country where our third-party service providers operate.
If You or Your Company acquired our Cloud OnDemand Services, please be informed that we collect and store the collected information in the United States, Singapore, Netherlands, or Romania, depending on the option that You or Your Company representative expressed when subscribing to our Services.
International Transfer of Personal Information
The Personal Information that we collect or receive about You when providing the Services and Software may be transferred to and processed by recipients which are located inside or outside the European Economic Area ("EEA"). 4PSA transfers Your Personal Information only to countries which provide an adequate level of data protection from a European data protection law perspective, as determined on the basis of an adequacy decision issued by the Commission. These countries are listed
here.
Other recipients might be located in other countries which were not recognized as offering an adequate level of protection from a European data protection law perspective, but in such a case 4PSA will take all necessary measures to ensure that transfers out of the EEA are adequately protected as required by applicable data protection law. With respect to transfers to countries not providing an adequate level of data protection the transfer is made based on appropriate safeguards, such as standard data protection clauses adopted by the European Commission or by a supervisory authority, approved code of conducts together with binding and enforceable commitments of the recipient, or approved certification mechanisms together with binding and enforceable commitments of the recipient.
With respect to Personal Information transferred from the EU, UK, or Switzerland to the U.S., please note the following:
4PSA complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce. 4PSA has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF. 4PSA has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern. In compliance with the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF, 4PSA commits to resolve DPF Principles-related complaints about our collection and use of Your Personal Information. EU and UK and Swiss individuals with inquiries or complaints regarding our handling of personal data received in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF should first contact 4PSA at:

In compliance with the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF, 4PSA commits to cooperate and comply respectively with the advice of the panel established by the EU data protection authorities (DPAs) and the UK Information Commissioner’s Office (ICO) and the Gibraltar Regulatory Authority (GRA) and the Swiss Federal Data Protection and Information Commissioner (FDPIC) with regard to unresolved complaints concerning our handling of personal data received in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF. The Federal Trade Commission has jurisdiction over 4PSA’s compliance with the EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF). Under certain conditions, You may have the possibility, under certain conditions, to invoke binding arbitration for complaints regarding DPF compliance not resolved by any of the other DPF mechanisms. The DPF Principles also describe our obligations with respect to Personal Information that we transfer to third parties as described elsewhere in this Policy. We remain responsible and liable as provided in the DPF Principles if the third party processes the Personal Information in a manner that is not consistent with the DPF Principles, unless we prove that we are not responsible for the event giving rise to the damage.
End-Users Note
4PSA Software and Services are designed for legal entities, not for individuals. Therefore, unless You or Your Company make available to us Your Personal Information within or in relation to our Software or Services provided to Your Company, 4PSA will not act as a data controller in relation to Your Personal Information. In such a case, Your Company is responsible for processing Your Personal Information and such processing is subject to Your Company’s privacy policy.
If You use an email address provided by Your Company or another legal entity to access the Services or Software, (i.e. your office email address), then the owner of the domain associated with Your email address (e.g. Your Company) may have administration rights and control over Your account and use of the Services or Software at a later date.
Services or Software Offered to Children
The 4PSA Services and Software are not designed for children under sixteen (16). You must declare that You are over sixteen (16) when accessing or using the Service or Software. If 4PSA become aware that it has collected without knowing any Personal Information of children below sixteen (16), such information will be immediately deleted, and Services and Software associated with such users will be terminated.
Use of Cookies
When You visit the 4PSA Website, a cookie is placed on Your machine (if You accept cookies) or is read if You have visited the 4PSA Website previously.
